Just a quick update for everyone following the recent consultation on the proposed site rules.

Regency issued their consultation response on 19 December and residents have 21 days from that date to apply to the Tribunal if they disagree with any of the proposed rules. That takes us up to 9 January.

Because the consultation was carried out with each of us as individual residents, the Residents’ Association cannot submit a Tribunal application on behalf of the park. Any challenge has to come from individuals.

I’ve submitted an application myself - partly because I disagree with the proposed new pets rule, and also because there are procedural errors in the consultation process. Depending on how the Tribunal views those errors, it’s possible the whole set of proposed rules could be rejected and Regency would need to start again.

Please also bear in mind that some rules will be unchallengeable because they are required to comply with the site licence and safety obligations. These are what we call necessary rules. However, if you are thinking about challenging a rule, it may be worth speaking to us first - we can give you an idea of whether you have a realistic chance. The Tribunal fee is £118, and we don’t want anyone spending money on a challenge the court is unlikely to uphold.
